Natural Heritage Evaluation Review

Our Township contains a significant portion of the Oak Ridges Moraine (ORM) and is interested in finding a way to obtain the information required to support development within the ORM in an efficient and economical manner.  Our current practice is to request the property owner to provide a Natural Heritage Evaluation as described in the ORM Conservation Plan.  This report is then sent on to the Township's environmental advisor(s) for peer review, and amended as required.  The final document is used as the basis for a Site Plan agreement which is then registered on the property.

This process results in significant costs to the property owner (for the report, the peer review, and the Site Plan) and extended time frames (to prepare and review the report), and is the same for all development proposals (whether for a new dwelling on a vacant lot or for a 10m2 addition to an existing dwelling).

Since we receive applications for development within the ORM approximately 10-15 times a year, the Township is looking for ways to streamline this process, and have been considering options including Municipally directed studies, creating a list of consultants who would not be required to have their reports peer reviewed, the potential for preparing ‘scoped’ studies in certain circumstances, and other methods of protecting the Moraine features while permitting property owners to develop their land in a responsible manner.

We will be looking for information related to your firm’s qualifications, fees/cost estimates, and turn-around times for the preparation of Natural Heritage Evaluations, as well as any suggestions you might have related to how the process could be dealt with in a more efficient manner.  We are open to any proposals you may have – feel free to think outside of the box!

DO YOU OWN AN ALL-TERRAIN VEHICLE (ATV)?

Council on March 7th, 2011 passed a by-law 11-07 regulating ATV’s on municipal highways.

ATV’s will be permitted on municipal roads for a trial period of one (1) year ending March 31, 2012.  Please click here for a copy of the by-law.

An All-Terrain Vehicle or ATV is defined as an off-road vehicle that has four wheels, the tires of all of which are in contact with the ground; has steering handlebars; has a seat that is designed to be straddled by the driver, and is designed to carry a driver only and no passengers.

A highway includes any open and maintained road allowance under the sole jurisdiction of the Corporation of the Township of Adjala – Tosorontio including a common and public highway, street, road, avenue, laneway or bridge and includes the part which is actually used by the general public for the passage of vehicles and all of the area between the lateral property lines thereof and does not apply to highways under the jurisdiction of the Province or the County of Simcoe, unopened road allowances, private roads or boundary line roads (Townline).

All-Terrain Vehicles or ATV’s must comply with the Highway Traffic Act, as amended, Ontario Regulation 316/03 made under the Highway Traffic Act and the Off-Road Vehicles Act, as amended and shall only be operated between one half hour after sunrise to one half hour before sunset..  Copies of these Acts are available at http://www.e-laws.gov.on.ca
